This document constitutes a legally binding agreement between Evolve Moto Tours LLC (hereinafter referred to as "the Company") and the participating rider or non-rider accompanying the tour (hereinafter referred to as "the Client"). By booking a tour, the Client agrees to be bound by the following Terms & Conditions.
Article 1Booking, Payments, and Financial Obligations
Reservation and Deposit: To secure a reservation, the Client must submit a deposit of €1200 (Euros) at the time of booking. This deposit is fully refundable if the Client cancels more than five (5) months prior to the tour start date. If a cancellation is made within five (5) months of the scheduled tour start date, the deposit becomes non-refundable.
Invoicing: Upon booking request, a full invoice containing the total tour cost and the Company's official bank details will be sent to the Client.
Currency: All payments must be transferred and received in Euros (€).
Balance of Payment: The remaining balance of the total tour cost is due no later than ninety (90) days prior to the scheduled tour start date.
Bank Transfer Fees: All international bank charges and transaction fees associated with the transfer of funds must be fully covered by the Client. The exact invoiced amount must clear into the Company's account.
Security Deposit: A refundable security deposit of €500 is required before the start of the tour to cover potential motorcycle damage or loss of provided equipment. This deposit will be refunded upon the safe, undamaged return of the motorcycle.
Article 2Cancellations and Refunds
Cancellation by Client: All cancellations must be submitted in writing. The following tiered refund policy applies to the tour cost:

| 12 to 20 weeks | 90% refund of the remaining balance paid (the €1200 deposit is non-refundable). |

| Less than 8 weeks | No refund. |
Article 3Client Documentation and Insurance Requirements
Passports: The Client must possess a valid international travel passport with a minimum of six (6) months of validity remaining beyond the expected date of departure from Mongolia.
Licenses & Visas: The Client is solely responsible for obtaining a valid motorcycle endorsement on their driver's license, as well as arranging any necessary entry visas for Mongolia prior to arrival.
Travel & Medical Insurance: The Client must hold comprehensive travel and medical insurance that explicitly covers off-road motorcycle riding and emergency helicopter evacuation.
Article 4Assumption of Risk, Cultural Respect, and Tour Alterations
Acknowledgment of Risk: Participation in the tour is undertaken entirely at the Client's own risk. The Client acknowledges that they will be operating a 450cc motorcycle across challenging terrains.
Expected Terrains and Conditions: The Client fully understands that the route will include, but is not limited to: dirt and sandy tracks, rocky paths, loose gravel, high mountain passes, river crossings, muddy valleys, and swamps, as well as potential extreme weather conditions (heavy rain, snowstorms, and sandstorms).
Cultural Respect and Local Laws: The Client must comply with all local laws and customs of Mongolia. As Mongolian culture holds a deep spiritual reverence for "Mother Nature," the Client agrees to show the utmost respect for the environment, local Nomadic families, wildlife, and livestock herds at all times. The Client must strictly follow the Tour Leader's guidance regarding cultural protocols and respectful interactions.
Tour Modifications: The Company reserves the right to modify, alter, or divert tour dates, routes, itineraries, or accommodations at any time if deemed necessary due to weather conditions, safety concerns, or unavoidable circumstances (force majeure).
Article 5Motorcycle Operation and Damage Liability
Custody of Vehicle: The motorcycle assigned to the Client remains their strict responsibility from the moment it is handed over until it is officially returned at the end of the tour.
Unauthorised Use and Adjustments: The Client is strictly prohibited from allowing any third party (including locals or bystanders) to sit on or ride the assigned motorcycle. Furthermore, the Client shall not alter or change any mechanical settings on the motorcycle without explicit prior approval from the Tour Leader or the Company mechanic.
Authority of Tour Leader: The Client agrees to obey and adhere to the instructions of the designated Tour Leader at all times.
Zero-Tolerance Policy: The Company enforces a strict zero-tolerance policy regarding riding under the influence of alcohol or drugs, in accordance with Mongolian law. Any violation will result in immediate exclusion from the tour with no refund.
Mishandling and Stunts: The Client is 100% financially responsible for any and all damage caused to the motorcycle due to mishandling, stunts, reckless riding, crashing, drowning (water submersion), or any other incident caused by the Client's actions.
Definition of Damage: Minor scratches or light cosmetic wear will not be considered chargeable damage. However, any structural or functional damage requiring replacement parts - including but not limited to broken levers, pedals, bent handlebars, or a broken subframe - will be classified as chargeable damage.
Severe Mechanical Damage and Shipping: All damages will be charged based on the cost of replacement parts. In the event of severe damage to the engine, transmission box, or other critical components requiring replacement parts to be ordered internationally, the Client shall be responsible for covering the full cost of the parts as well as the express international shipping fees.
Article 6Release of Liability
Liability Waiver: Evolve Moto Tours LLC, its staff, owners, mechanics, tour guides, and other clients within the riding group shall not be held liable for any personal injury, illness, death, loss of property, or property damage sustained by the Client during the tour.
Emergency Evacuation Liability: Due to the remote nature of the Mongolian wilderness, the Company is not financially liable for any costs related to emergency medical rescues, helicopter evacuations, or subsequent hospital treatments. All such costs must be borne by the Client and their insurance provider.
Article 7Governing Law and Jurisdiction
Jurisdiction: Any disputes, claims, or legal matters arising between the Client and the Company from this agreement or participation in the tour shall be governed by, and resolved exclusively under, the laws and jurisdiction of Mongolia.
